By using the APK website and services, you agree to be bound by these Terms of Use. These terms are governed by the laws of Kenya.
By registering for or using the APK Kenya platform at apk.co.ke, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms constitute a legally binding agreement between you and Aviation Professionals of Kenya.
Membership is open to aviation professionals currently employed or studying in the aviation industry in Kenya, who are at least 18 years of age, and who provide accurate and truthful information. APK Kenya reserves the absolute right to verify eligibility at any time and to reject, suspend, or cancel any membership that does not meet our criteria, without liability.
APK Kenya offers Monthly and Annual membership plans. Annual plans are billed yearly at a discounted rate equivalent to one free month. Founding Member status is a special designation for early members. All fees are in Kenya Shillings (KES) and are non-refundable unless required by Kenyan law. APK Kenya reserves the right to adjust pricing with 30 days notice.
Membership fees are payable via M-Pesa or Pesapal. By providing payment details, you authorise APK Kenya to charge the applicable fee. APK Kenya does not store card numbers or M-Pesa PINs. APK Kenya is not liable for payment processing errors by third-party providers.
After payment, your application requires admin review and submission of a clear photograph and proof of aviation credentials. Verification is typically completed within 2 to 5 business days. APK Kenya reserves the right to reject any application at its sole discretion. Your name and photograph are locked after verification and cannot be changed. Any attempt to circumvent this will result in immediate termination.
Your digital APK membership card is personal and non-transferable. It features a dynamic QR code that refreshes every 60 seconds. You must not share your card, screenshots of your QR code, or your login credentials with any other person. Misuse of the membership card will result in immediate termination without refund and may result in legal action.
Member benefits are subject to the specific terms of each partner venue, available only upon QR scan verification, non-transferable to non-members, not combinable with other offers unless stated, and subject to availability and partner discretion. APK Kenya is not a party to any transaction between you and a partner venue. Disputes must be resolved directly with the partner. APK Kenya does not guarantee the continued availability of any specific benefit and may modify or remove partners at any time without liability.
You must not provide false or misleading information; use the platform for any unlawful purpose; attempt to gain unauthorised access to the platform; scrape or extract data without permission; interfere with the platform operation; impersonate another member or APK Kenya personnel; share your membership benefits with non-members; or engage in any conduct harmful to APK Kenya, its partners, or other members. Violation may result in immediate suspension or termination without refund.
APK Kenya reserves the right to suspend or terminate any membership at any time without prior notice for breach of these Terms, provision of false information, misuse of the membership card, or conduct harmful to APK Kenya, its partners, or other members. You may appeal within 14 days by contacting apk.kenya@gmail.com. APK Kenya's decision on appeals is final. No refund will be issued for the remaining period of your billing cycle upon cancellation.
All content on the APK Kenya platform is the intellectual property of APK Kenya and is protected by Kenyan copyright law and international conventions. You may not reproduce, distribute, or create derivative works without express written permission.
To the maximum extent permitted by Kenyan law, APK Kenya is not liable for any indirect, incidental, or consequential damages arising from use of the platform or partner benefits. APK Kenya's total liability for any claim shall not exceed the total membership fees paid by you in the 12 months preceding the claim. APK Kenya is not responsible for the actions or conduct of any partner venue.
You agree to indemnify and hold harmless APK Kenya, its directors, officers, employees, and agents from any claims, losses, damages, liabilities, and legal costs arising from your breach of these Terms, your use of the platform, or your interaction with partner venues.
These Terms are governed by the laws of Kenya. Any dispute shall first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, disputes shall be referred to mediation or arbitration under the Nairobi Centre for International Arbitration (NCIA) rules. The courts of Kenya shall have exclusive jurisdiction over disputes that proceed to litigation.
APK Kenya may update these Terms at any time. We will notify you of material changes via email and by posting the updated Terms with a revised effective date. Continued use of the platform after the effective date constitutes acceptance.
